Mopani Copper Mines Plc v Millennium Underwriting Ltd

Colin Edelman QC successfully appeared for the defendant underwriters in this matter. The High Court held that, although an amended slip for a construction all risks reinsurance policy had contained mention of operational risks cover, it was clear from the sequence of agreements that it had not been intended that cover for general operational risks was included. In interpreting the agreement it had been legitimate to read deleted words to establish what the parties had expressly agreed was yet to be agreed.
