Professional Negligence
Members of chambers advise and represent clients in professional negligence cases in a wide range of trades and professions including solicitors, barristers, accountants, auditors, independent financial advisers, insurance brokers, members' and managing agents at Lloyd's, architects, structural engineers, surveyors and valuers, and other advisers and consultants in fields as diverse as agriculture, IT and telecommunications.
We are involved in the whole spectrum of professional negligence work from advising clients as to the merits and quantum of cases through drafting pre-action protocol letters of claim and response, statements of case and mediation position statements, to attending mediations and, where disputes are not resolved at an earlier stage, representing clients in arbitrations, at trial or on appeal.
A great deal of our work is conducted for professional clients and their insurers, and members of chambers regularly act for claimants across the whole width of professional negligence claims. We are also regularly instructed by professionals and by their insurers in relation to insurance coverage issues. The value of cases in which members of chambers are involved ranges from tens of millions of pounds to just a few thousand. Our clerks are aware of the importance of ensuring that fees are proportionate both to the seriousness of the issues and to the financial value of each individual case.
Members of chambers advise and represent prosecuting bodies and defendants in professional disciplinary tribunals, on appeal and in applications for judicial review. We also accept instructions to appear at inquests to protect the interests of professionals and their insurers.
Senior members of chambers also sit as arbitrators and mediators. Our Queen's Counsel accept instructions to give opinions pursuant to 'QC' clauses in professional indemnity insurance policies and similar dispute resolution mechanisms.
