Environmental

Members of Chambers have had over the years a wide range of experience on all aspects of environmental law. This has ranged, for example, from environmental issues in commercial and property law to administrative law reviews, to so called "toxic torts" actions and to acting in criminal environmental law cases. They have acted for insurers, large industrial conglomerates, public utilities (such as water and sewage undertakers), local authorities and legally aided Claimants. Various members have been listed over the years in Chambers & Partners and Legal 500 as leading environmental law specialists. In addition to litigation, members of chambers have advised on a range of environmental law matters including advising:

  • Local Government Authorities on Waste Disposal contracts;
  • Commercial organisations on environmental aspects of property deals;
  • Government Agencies on the environmental aspects of commercial contracts;
  • upon Environmental issues arising from the construction of National Sports Stadium.

Members of Chambers have lectured on the law of nuisance and toxic releases and written various articles for a wide range of publications for example Management Today's Corporate Environmental Performance 2000.

Examples of reported cases include:

  • Reay v. British Nuclear Fuels [1994] 1 MLR 1 (a year long trial involving radiation exposure at Sellafield),
  • R v. Secretary of State for Trade and Industry v Ex parte Duddridge Independent 4th October 1994 (Divisional Court) and the Times 26th October 1995 (Court of Appeal) (Judicial review into the applicability of Article 130r of the European Treaty and Community Policy on the Environment and the Pre-cautionary principle).
  • Ngcombo v. Thor Chemical Holdings, the Times 10th November 1995 (Procedural aspects of mercury poisoning case)
  • R v. Greenwich London Borough Council Ex parte Williams, the Times 29th December 1995 (first instance) and [1996] 8 CL 448 (Court of Appeal). (Highway authorities' powers under the Road Traffic Regulation Act 1984 to close roads on air pollution grounds).
  • Africa v. Cape Plc [2001] 1 WLR 1545 (House of Lords decision on forum non conveniens relating to asbestos manufacturers liability)
  • R v. Anglian Water Services Limited [2003] EWCA Crim 2243 (Test case on sentencing levels for water pollution by sewage undertakers.)
