Ben Lynch appears in important solicitors' negligence limitation case

Ben Lynch successfully acted for the Defendant in Nouri v Marvi & Others, an important solicitors’ negligence limitation case.

The case is the latest in a long line of hotly disputed post-Sephton cases on the meaning of “material damage” for the purposes of s.2 Limitation Act 1980. The other cases include Axa and Pegasus.

The case is particularly significant for solicitors and their professional indemnity insurers, as the Court followed Bell v Peter Browne & Co [1990] 2 QB 495, CA and found that limitation started to run at the earliest possible date.

The judgment is reported at [2010] PNLR 7. Permission to appeal has been granted.
