Mohinderpal Sethi appears in BGC v Tullett Prebon team move litigation

Mohinderpal Sethi acted for the Defendant broker, Mr Rees, in the latest High Court trial following the 2009 team move from Tullett Prebon to BGC.  Mohinderpal had also advised the Tullett brokers who had initially signed forward contracts with BGC but who were then persuaded to stay at Tullett, and who became known in the ensuing litigation as 'the Tullett Three'.

Following a two week High Court trial, Jack J found that whilst Mr Rees was not justified in terminating his contract early, BGC had failed to show 'by some way' that any loss resulted from the breach, and made a series of other findings on the claims and counter-claims put forward by the parties including wrongful termination, constructive dismissal, breach of restrictive covenants, misuse of confidential information, inducement, loss of profits and Wrotham Park damages under both Swiss and English law.
