CA judgment in PMC anonymity case

In PMC v CWM Taf Morgannwg UHB [2025] EWCA Civ 1126, the Court of Appeal allowed the claimant’s appeal and made an anonymity order in favour of the claimant, who has cerebral palsy following a birth injury.  The CA accepted the claimant’s arguments that the court had inherent jurisdiction at common law to make not just a withholding order but also a reporting restriction order. It also accepted that section 11 of the Contempt of Court Act 1981 could be engaged provided a withholding order was made at some stage during proceedings.

The Court of Appeal recognised that the claimant merited an anonymity order given his extreme vulnerability and the serious infringement upon his private and family life in relation to medical details, family circumstances and financial matters that the litigation will involve. The fact that the claimant had received substantial earlier publicity in the press was not a bar to the making of such an order.
