Judge confirms procedure relating to the introduction of further witness evidence at trial
In this clinical negligence trial Robert Weir QC, leading Robert Sowersby from Guildhall Chambers, acted for the family of a patient who died of a heart attack within hours of seeing the defendant GP. On the first day of trial, the defendant sought to introduce a further witness statement at odds with her earlier statement served within time.
HHJ Seys-Llewellyn QC held that such an application did not engage CPR 3.10 and the Denton principles but was governed by CPR 1.1. He went on to exclude the defendant’s further evidence. The trial settled on day 2.
