Robert Weir QC in key Snatch Land Rover judgment
Robert Weir QC acts for the relatives of soldiers killed in Snatch Land Rovers in Iraq. In Smith and others v MoD [2011] EWHC 1676, Owen J ruled on the MoD's application to strike out the claims in negligence and under Article 2.
The negligence claims were allowed to proceed, making this the first case of its kind in which complaints about equipment failures by the Army resulting in deaths in combat can be taken to trial. The judge struck out the Article 2 claim but on a narrow jurisdictional basis. Both sides are intent on appealing.
