Stephen Killalea QC in £3.55 million Court approved settlement of brain damage case

The Court approved settlement of a brain damaged young man’s personal injury action.

The Claimant was aged 17 and had been in the Army for less than a year when he sustained brain damage in a road accident. The claim was settled after extensive negotiations on the basis that the Claimant shall receive a gross lump sum of £1.75 million plus a periodical payments order of £60,000 per annum. (Capitalised value: £3.55 million.)

Although the Claimant has retained his intellect there are significant deficits relating to behaviour, insight, judgement and planning. Significant issues arose in relation to his managing his finances and social behaviour.

The PPO reflected the provision of several hours of Buddy support per day for life in spite of evidence of a lack of engagement and a desire for independence.
