Andrew Burns QC, Lucinda Harris and Katya Hosking examined the question of direct or indirect discrimination between shared parental leave and maternity leave and analyse the comparison as an equal pay issue – looking at why the Court of Appeal held that the sex equality clause does not apply.
Now that permission to appeal to the Supreme Court has been refused in both Ali v Capita and Hextall v the Chief Constable Leicestershire Police, the hosts consider what the Court of Appeal decision means for employers, and in particular whether businesses need to harmonise all family friendly policies.
