Rob Weir KC wins credit hire appeal
In Morgan-Rowe v Woodgate [2023] EWHC 2375 (KB), Julian Knowles J upheld a recorder’s decision that the claimant was deemed impecunious despite having an ISA of £12,000 and a full-time job. Accordingly, the claimant was entitled to recover the cost of a credit hire lasting 2 months.
In his detailed judgment, Julian Knowles J did not permit the defendant to raise an argument for the first time in her skeleton argument, which was plainly at odds with her case in her Grounds of Appeal holding that it was not open to a litigant to ‘chop and change’ how they advanced their case.
